The Committee on Civil Liberties, Justice and Home Affairs (LIBE) votes on its position on the reform of the Schengen Borders Code (Union Code), which include new rules governing the movement of persons across borders. MEPs want to ensure a coherent EU response in cases of large-scale public cross-border health emergencies, allowing temporary restrictions on entering the Schengen area, but exempting from them EU citizens, long-term residents and asylum-seekers. As an alternative to border controls, the new rules would promote police cooperation in border regions. The Parlamentarians discuss the strengthening of EU cooperation with Tunisia on migration. Following an increase in arrivals of migrants by boat from Tunisia via the Central Mediterranean route, MEPs will with the Spanish Council Presidency and the Commission the recent memorandum of understanding between the EU and Tunisia. The 2023 Rule of Law Report, including its 27 country chapters, examines developments across all Member States, both positive and negative, in four key areas for the rule of law: the justice system, the anti-corruption framework, media pluralism and freedom, and other institutional issues related to checks and balances. The country chapters, which rely on a qualitative assessment carried out by the Commission, analyse new developments since the previous Report and the follow-up to the challenges and developments identified in the 2022 edition.

2023 Annual Rule of law report: MEPs debate

MEPs debate on their position on rules to protect journalists, activists, academics, artists and researchers against legal actions aimed at silencing them. The draft directive provides minimum standards of protection from lawsuits against public participation (SLAPP) in the EU through early dismissal of these cases, obliging the claimant to cover the costs of proceedings and not recognising third country judgements. The rules should apply in cross-border cases when the claimant and defendant are not based in the same country as the court or when the case is relevant to more than one member state and the disputed work can be accessed electronically. Protection of journalists and human rights defenders from manifestly unfounded or abusive court proceedings: MEPs debate

Jointly, LIBE (Civil Liberties, Justice and Home Affairs) and FEMM (Women’s Rights and Gender Equality) Committees vote on EU legislation to fight violence against women and domestic violence. MEPs want a uniform criminal definition of rape based on the absence of consent, for cyber violence to be a crime under EU law (including non-consensual sharing of intimate material), and safer and gender-sensitive procedures for reporting incidents.
